Wills:

A will sets forth your wishes on how your property should be distributed and identifies who should manage your estate as the executor or executrix. Wills also can designate guardians of minor children, create trusts for beneficiaries, and otherwise set forth your wishes.

 

Revocable Trusts:

Revocable trusts (sometimes called Living Wills) can be useful tools to help you avoid the costs of probating your will.  In addition, revocable trusts can be used to enhance incapacity planning and prevent will contests.

 

Ancillary Documents

Durable Powers of Attorneys:

Through the use of a durable power of attorney, you can designate agents who can make financial decisions on your behalf, even if you become incapacitated.

 

Medical Powers of Attorney:

You can use a Medical Power of Attorney to designate agents to make health care decisions for you when you are unwilling or unable to make those health care decisions. Medical Powers of Attorney can also include language that grants your agents the authority to have access to your medical records.

 

Directive to Physicians (living wills):

By signing a Directive to Physicians and Family or Surrogates, you can inform your family and medical team that if you are in a Terminal Condition or an Irreversible Condition whether you would like to be kept alive using life support or be take off of life support.
