Under Texas law, the probate process can take several forms depending upon whether the deceased party left a valid will.
If the deceased party did not leave a valid will, the deceased party’s property passes under the laws of intestacy, sometimes called intestate succession under the Texas Estates Code.
Generally, the probate process involves collecting the probate assets of the decedent, paying appropriate debts and expenses of the decedent, and distributing the balance to the beneficiaries listed in the decedent’s will or heirs as set forth in the Texas Estates Code.
